A New Jersey couple who each lost a leg in a motorcycle accident caused by a teenage distracted driver settled their lawsuit against the driver.
The tragic accident occurred because the teenager was reading a text message when he struck the motorcycle. In what is believed to be the first case of its kind, the couple also sued the teenage driver’s girlfriend who sent the text message, arguing that she was “electronically present” and contributed to the crash. The court dismissed the lawsuit against the girlfriend, ruling that it is the driver of a vehicle who is responsible for its safe operation. The couple plans to appeal the court’s ruling.
As part of the teenager’s guilty plea to distracted driving, the court ordered him to speak to 14 high schools about the dangers of texting and driving.
