Appeals Court Overturns Jury Award For Hair In Food

Back in 2008, a cook at the Texas Roadhouse restaurant in West Bend, Wisconsin placed some of his hair in a steak served to Kevin Hansen, after Mr. Hansen had complained that his food was overcooked. When Mr. Hansen took the steak home to eat, he discovered the hair. Mr. Hansen sued the restaurant as a result of the incident.

Following a trial, the jury awarded $125,000 to Mr. Hansen, despite answering “no” to the question of whether the restaurant was negligent. The trial judge approved the damage award, deciding that the jury verdict implied that the restaurant was negligent. The restaurant appealed the decision, and the Court of Appeals of Wisconsin reversed the jury award.
