Appeal Court Rules That Underinsured Motorist Policy Covers Deputy Injured While Directing Traffic

A Milwaukee County Sheriff’s Deputy was directing traffic on foot at General Mitchell International Airport when she was struck by an underinsured driver. The deputy sustained injuries as a result of the accident. Milwaukee County’s insurance policy with Wisconsin County Mutual Insurance Company provides underinsured motorist coverage if a deputy is using an automobile within the scope of his or her employment. Initially, a trial court found that the deputy was not entitled to insurance coverage, because she was not using the underinsured vehicle. The Court of Appeals of Wisconsin reversed, holding that the deputy was using the underinsured vehicle by directing it back into traffic after the driver had pulled to the curb.
